By creating an account, browsing products, or placing orders on Toonga, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, along with our Privacy Policy.

If you do not agree with any part of these terms, please discontinue use of our services immediately.

Toonga operates as a multi-vendor e-commerce marketplace connecting customers with:

• Independent vendors and retailers offering beverages, electronics, travel packages, and more
• Experience partners providing event tickets, nightlife experiences, and entertainment
• Service providers offering delivery, logistics, and customer support
• Payment processors facilitating secure transactions

Important Distinction: Toonga acts as an intermediary platform. Individual vendors are responsible for product quality, pricing, availability, descriptions, and fulfillment. Toonga facilitates transactions, provides payment processing, order tracking, and customer support infrastructure.

When you create an account with Toonga, you agree to:

• Provide accurate, complete, and current registration information
• Maintain and promptly update your account information
• Keep your password confidential and secure
• Notify us immediately of any unauthorized access or security breach
• Accept responsibility for all activities under your account

Toonga reserves the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or pose security risks to our platform or users.

Order Process: All orders placed through Toonga are subject to acceptance and confirmation by the respective vendor. We reserve the right to refuse or cancel orders for reasons including product unavailability, pricing errors, or suspected fraudulent activity.

Pricing: Product prices are set by individual vendors and displayed in Rwandan Francs (RWF) or other supported currencies. Prices may change without prior notice. The price charged will be the price displayed at the time of order confirmation.

Payment:

• We accept multiple payment methods including mobile money (MTN, Airtel), credit/debit cards, and Toonga Pay
• All payments are processed securely through our payment partners
• Transaction fees, delivery charges, and applicable taxes are clearly displayed at checkout
• Payment must be completed within the specified timeframe or your order may be automatically cancelled

Delivery timelines and shipping costs vary by vendor, product type, and delivery location. Estimated delivery dates are provided at checkout but are not guaranteed.

• Standard delivery typically takes 1-5 business days within Kigali
• Express delivery options may be available for select products and locations
• You will receive tracking information once your order has been dispatched
• Failed delivery attempts may result in return to sender or storage fees

You are responsible for providing accurate delivery information. Toonga is not liable for delays or failures resulting from incorrect addresses or unavailability to receive deliveries.

Cancellations: Orders can be cancelled before shipment through your account dashboard or by contacting customer support. Cancellation may not be possible once items have been dispatched.

Returns: Return eligibility depends on product category and vendor policies:

• Defective or damaged items: Full refund or replacement within 7 days of delivery
• Incorrect items: Exchange or refund within 7 days
• Change of mind: May be subject to restocking fees and vendor approval
• Perishable items, beverages, and event tickets are generally non-returnable

Refunds: Approved refunds are processed within 5-14 business days to your original payment method. Refund timelines may vary by payment provider.

You agree NOT to:

• Violate any applicable laws, regulations, or third-party rights
• Impersonate any person or entity, or falsely represent affiliation
• Engage in fraudulent activities or use stolen payment methods
• Manipulate product rankings, reviews, or ratings
• Distribute malware, viruses, or harmful code
• Attempt to gain unauthorized access to our systems or user accounts
• Scrape, crawl, or extract data from our platform without permission
• Interfere with the proper functioning of the platform
• Use the platform for any illegal purpose including money laundering

Violations will result in immediate account suspension or termination, and may be reported to law enforcement authorities.

All content on the Toonga platform, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, software, and the compilation thereof (the "Content"), is the property of Toonga or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws.

• The Toonga name and logo are registered trademarks
• You may not reproduce, distribute, modify, or create derivative works without explicit written permission
• Product images and descriptions are property of respective vendors
• User-generated content (reviews, photos) remains your property but you grant us a license to use it

Your privacy is important to us. Our Privacy Policy explains how we collect, use, disclose, and safeguard your personal information.

By using Toonga, you consent to our data practices as described in the Privacy Policy, including:

• Collection of personal and transaction data
• Use of cookies and tracking technologies
• Sharing information with vendors, payment processors, and service providers
• Communications for orders, promotions, and service updates

To the maximum extent permitted by law:

• Toonga is not liable for any indirect, incidental, special, or consequential damages
• Our total liability for any claim is limited to the amount you paid for the specific product or service
• We do not guarantee uninterrupted or error-free service
• We are not responsible for vendor actions, product quality, or third-party services
• We are not liable for losses due to circumstances beyond our reasonable control

Customer Support: Most issues can be resolved through our customer support team. Contact us first before pursuing formal dispute resolution.

Claims Process:

• All claims must be raised within 30 days of the incident
• Submit detailed information and supporting evidence
• We will investigate and respond within 14 business days
• If unresolved, the dispute may be escalated to mediation

Governing Law: These Terms are governed by the laws of Rwanda. Any legal proceedings shall be conducted in the competent courts of Kigali, Rwanda.

Toonga reserves the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website or app.

• Material changes will be communicated via email or in-app notification
• Continued use after changes constitutes acceptance of new terms
• The "Last Updated" date at the top indicates when terms were last modified

We encourage you to review these Terms periodically to stay informed of any updates.

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Entire Agreement: These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Toonga.

No Waiver: Our failure to enforce any right or provision shall not constitute a waiver of that right or provision.

Assignment: You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations without restriction.
